Please read the following terms and conditions carefully to ensure that you are fully aware of your rights and obligations when registering for Krys the Maximizer’s digital products and services.

Your registration for any of our digital products, services or event signifies your agreement to be bound by these terms and conditions, which constitute a contract between Krys The Maximizer’s digital products, services and coaching (otherwise referred to as “we” or “us”) and you, the participant.

We may, from time to time, vary, amend, alter or review these terms and conditions and will provide a notification via our website located at www.krysthemaximizer.com/ktmterms (our Site) and/or any other suitable location. All amendments will be effective immediately upon a notification being displayed..

PURCHASE AND ACCESS

You will only be able to access content relating to any of our digital products and services such as Content Cash Out and others, which include but not limited to, webinars, live training, challenges, e-books, boot camps, courses, live coaching, which you have purchased or registered for.

You must provide complete and accurate details at the time of registering for any of our services. You may be required to provide additional details upon our request to ensure the accuracy of your purchases.

Since we have multiple platforms for delivering our services, information and access to each or any of our digital products or services you have subscribed to will be delivered will be delivered via your email address you have supplied to us during purchase.

You may have access to highlights from the digital courses and any tools that you may need to make you enjoy absolutely while your payment plan subsists, according to the timeframe stated on the sales page. Your access to the paid services or products will be terminated after this time.

TERMINATION OF ACCESS

We reserve the right to terminate your access to any products or services, immediately and without notice, if you engage in any conduct that is in contravention of our practice and procedures. You will not be entitled to receive any refund, or part hereof, if such termination takes place.

PURCHASE PRICE

All prices and transactions displayed on our Site are to be paid for in USD and include Goods and Services Tax (GST).

We reserve the right to vary the prices displayed in connection with a product from time to time and without notice to you.

PAYMENT PLAN AND PAYMENT

Our products and services have different payment plans attached to each of them. Once a payment plan is chosen and activated, you MUST complete the payment regardless of any change of mind or interest.

You may pay for our digital products or services via any payment method stated as being accepted on our Site and such payment method is stored securely on the Site without Krys the Maximizer having access to the complete details. Please, send us an electronic mail if you need to organize an alternate arrangement.

Once we receive your initial payment, we will grant you access to the product or service purchased. If you default in the payment plan, you will have your access terminated until the payment is made.

PROCESSING PURCHASES

We process purchases on business days only, which are Monday to Friday and exclude public holidays. Note, however, that all purchases made on a non-business day will be processed on the next business day.

CANCELLATION OF PURCHASES

Membership Cancellation

All payments must be completed, regardless if you use the service or not. If you have a grandfathered month-to-month membership, kindly send an email to [email protected] to request a cancellation form. You must complete the form to be able to cancel.

Cancellation by you

All registrations for any of our digital products or services are final and cannot be cancelled by you. If you are no longer interested in completing the service you have already paid for, you can email us, BUT you will not be entitled to any credit voucher to that effect.

Our services are digital, we do not accept any request for transfer of purchase access to a third party by you. For detailed information about this, read our Terms of Use.

Cancellation by Krys the Maximizer

We may cancel your registration for any digital product or service, if for any reason, we are unable to provide it. We will provide you with full information of why we could not go ahead with the rendering of the product or service and subsequently reschedule same. You have our words that we will offer comparable or best service in the event that we cancel or reschedule.

You will not be entitled to claim any additional amounts or seek compensation for any loss, expense or damage (either direct or consequential) or for any loss of time or inconvenience, which may result from our cancellation of any digital product or service.

REFUNDS

All fees paid in association with your purchase of a product or services are NON-REFUNDABLE, unless we are required to make a refund under the any applicable Consumer Law. You may contact us at [email protected]

FORCE MAJEURE

In this section of these Terms, “Event of Force Majeure” means an event beyond the control of Krys the Maximizer which prevents a Party from complying with any of its obligations under these Terms, including but not limited to, further consequences from the Covid-19 pandemic, an act of God (such as, but not limited to, fires, explosions, earthquakes, drought, tidal waves and floods), war, military action, hostilities, rebellion, riots, strikes, epidemic, famine or plague, acts of threat or terrorism or action of a court.

In an Event of Force Majeure;

Krys the Maximizer will not be considered to be in breach of these Terms, to the extent that performance of its respective obligations (excluding payment obligations) is prevented by an Event of Force Majeure, which arises after the date that these Terms are entered into;

• we will provide written notice outlining the inability to host any digital product or service; and

• you will be entitled to a credit towards another comparable digital product or service to be hosted at a later date, but not a REFUND OR REPAYMENT.

INTELLECTUAL PROPERTY

All material contained in, or connected with, our digital products and service or any other service, is owned or under license by Krys the Maximizer and protected by the United States of America’s laws and other applicable international laws and regulations.

Your purchase of a digital product or service does not grant you a license or act as a right of use of any of the course materials, or trademarks or logos, whether registered or unregistered, contained in, or connected with, our services without the express written permission from us.

We own the copyright, which subsists in all creative and literary works that are contained in, or connected with, our services subject to certain works being under license. You must not:

• reproduce or use any of the materials contained in, or connected with, our services; or

• in any way modify the material contained in, or connected with, our services.

In summary, you must not modify, copy, reproduce, republish, frame, upload to a third party, post, transmit or distribute any material or trademark connected with any or all digital products and services provided by us, such as courses, classes, physical products, in-person events, in any way except as expressly provided for or contained in, or connected with, the said digital products or other services.

ENFORCEMENT OF OUR INTELLECTUAL PROPERTY RIGHTS

We will not, under any circumstances, tolerate infringement of its intellectual property, whether such infringement is inadvertent or otherwise. In the event that you do any of the prohibited acts as listed above or infringes upon its intellectual property in any other way, we will enforce our intellectual property rights against you.

THE INFORMATION PRESENTED IN ANY OF OUR DIGITAL PRODUCTS OR SERVICES OR ANY OTHER SERVICE RENDERED BY US IS TO ONLY SERVE AS GENERAL INFORMATION ONLY. YOU ACKNOWLEDGE, ACCEPT AND AGREE THAT BY ENROLLING IN A DIGITAL PRODUCT OR SERVICE, YOU ARE FULLY RESPONSIBLE FOR THE RESULTS DERIVED FROM YOUR PARTICIPATION IN ANY OF OUR SERVICES. WE OFFER NO REPRESENTATIONS, WARRANTIES OR GUARANTEES, VERBALLY OR IN WRITING, REGARDING YOUR PERFORMANCE OR ANY CERTAIN RESULTS THAT YOU MAY OR MAY NOT ACHIEVE, AS ACONSEQUENCE OF YOUR PURCHASE OR PARTICIPATION IN OUR DIGITAL PRODUCTS AND SERVICES.

LIABILITY

TO THE EXTENT PERMITTED BY LAW, INCLUDING BUT NOT LIMITED TO ANY ACT OR OMISSION ON YOUR PART, WE WILL NOT BE LIABLE FOR ANY LOSS, DAMAGE, COSTS OR EXPENSE WHETHER DIRECT, INDIRECT, INCIDENTAL, SPECIAL AND/OR CONSEQUENTIAL, INCLUDING LOSS OF PROFITS, SUFFERED BY YOU OR CLAIMS MADE AGAINST YOU WHICH RESULT FROM ANY USE OR ACCESS OF, OR ANY INABILITY TO USE OR ACCESS, INFORMATION RELATING TO OUR DIGITAL PRODUCTS AND SERVICES.

All personal information that we collect about you will be handled, treated and stored in accordance with our Privacy Policy, which you agree to by agreeing to these terms and conditions.

CONSENT

By agreeing to these terms and conditions, you also consent to receive further electronic communications from us in relation to Krys the Maximizer business, including information relating to course offerings, competitions, promotions, special offers and any other commercial message. Of course, you may send us an email via [email protected] at any time to unsubscribe from receiving electronic commercial messages from us.

GOVERNINGLAW

The laws of the United States of America from where we operate shall govern these terms and conditions.
